When Negotiation
Isn't Enough

Some debtors simply refuse to pay, dispute a valid debt, or disappear. In these cases, legal action is the only route to recovery. HCM's in-house legal team handles everything — from issuing formal legal demands to obtaining court judgments and enforcing them against debtor assets.

Crucially, our legal recovery service remains on a no-win, no-fee basis. You face no financial risk — we only earn when you receive your money.

Our Legal Recovery Pathway

01
Legal Demand Letter

A formal letter before action issued by our solicitors, giving the debtor a final opportunity to pay before proceedings begin.

02
Court Proceedings

If no response, we file a claim in the appropriate US court. Our team manages all filings, hearings and procedural steps.

03
Judgment Obtained

We obtain a court judgment confirming the debt is owed — this becomes a legal instrument enforceable against the debtor.

💰
Enforcement & Recovery

We enforce the judgment via asset seizure, bank account garnishment or writ of execution to recover your funds in full.

Legal FAQs

Common Legal Recovery Questions

Our legal recovery service operates on a no-win, no-fee basis. You pay nothing upfront and our fee is a pre-agreed percentage of the amount recovered. Court filing fees may be recoverable from the debtor as part of the judgment.

Uncontested cases typically resolve in 60–90 days. Defended cases or complex disputes may take 4–12 months depending on the court and jurisdiction. We provide regular updates throughout the entire process.

Disputed debts are assessed by our legal team. If the dispute is without merit, we proceed with court action. If there are legitimate issues, we advise on the best course of action — which may include mediation or a negotiated settlement.

We typically recommend legal action for debts over $5,000 where negotiation has failed, as the cost-benefit is most favourable. For larger debts, legal action is almost always worthwhile. We assess each case individually and advise accordingly.
